1. Introduction / Pengenalan

Welcome to SMI Auto Sales & Services Sdn. Bhd., hereinafter referred to as “SMI Auto”, “SMI Car Rental”, “we”, “us”, or “our”. By accessing and using our website or rental services, you agree to comply with and be bound by these Terms of Use. Please read them carefully before using our services.

Selamat datang ke SMI Auto Sales & Services Sdn. Bhd., selepas ini dirujuk sebagai “SMI Auto”, “SMI Car Rental”, “kami”, atau “syarikat”. Dengan mengakses laman web dan menggunakan perkhidmatan kami, anda bersetuju untuk mematuhi dan terikat dengan Terma Penggunaan ini. Sila baca dengan teliti sebelum menggunakan perkhidmatan kami.

2. Eligibility / Kelayakan

You must:

• Be at least 21 years old.
• Hold a valid Malaysian or international driving licence.
• Provide valid identification (NRIC or passport).
• Have no record of serious traffic or criminal offences.

Anda mesti:

• Berumur sekurang-kurangnya 21 tahun.
• Mempunyai lesen memandu Malaysia atau antarabangsa yang sah.
• Menyediakan pengenalan diri yang sah (IC atau pasport).
• Tiada rekod kesalahan lalu lintas atau jenayah yang serius.

3. Use of the Website / Penggunaan Laman Web

You agree not to use this website for any unlawful or fraudulent purpose. SMI Auto reserves the right to suspend or terminate your access if misuse or abuse is detected.

Anda bersetuju untuk tidak menggunakan laman web ini bagi tujuan yang menyalahi undang-undang atau penipuan. SMI Auto berhak menggantung atau menamatkan akses anda sekiranya terdapat penyalahgunaan.

4. Vehicle Reservation & Payment / Tempahan & Pembayaran

4.1 Reservation Confirmation

A reservation is only confirmed once full or partial payment has been received.

4.2 Payment Methods

We accept payments via FPX, credit/debit cards, or approved local gateways.

4.3 Deposit

A refundable security deposit is required before car collection. The deposit may be withheld for damages, traffic summons, or cleaning fees.

Tempahan hanya disahkan selepas pembayaran diterima. Pembayaran boleh dibuat melalui FPX, kad kredit/debit, atau gerbang pembayaran tempatan yang diluluskan. Deposit keselamatan yang boleh dipulangkan diperlukan sebelum pengambilan kenderaan dan boleh ditolak sekiranya berlaku kerosakan, saman trafik atau caj pembersihan.

5. Vehicle Use / Penggunaan Kenderaan

5.1 Authorized Drivers

Only the renter and listed additional drivers are permitted to drive the vehicle.

5.2 Prohibited Use

The renter shall not:

• Use the vehicle for racing, illegal activities, or towing.
• Allow unlicensed individuals to drive.
• Smoke or transport hazardous materials inside the vehicle.

5.3 Vehicle Condition

The renter must ensure the vehicle is returned in the same condition, clean, and free of new damage. Any violation may result in deposit deductions.

Hanya penyewa dan pemandu tambahan yang didaftarkan dibenarkan memandu kenderaan. Kenderaan tidak boleh digunakan untuk perlumbaan, aktiviti haram, atau menarik kenderaan lain. Penyewa bertanggungjawab memulangkan kenderaan dalam keadaan bersih dan baik seperti asal; jika tidak, deposit boleh ditolak.

6. Insurance & Liability / Insurans & Tanggungjawab

6.1 Coverage

All vehicles are covered under Company Insurance / Third-Party Insurance (as applicable).

6.2 Claim Rejection

If an insurance claim is rejected due to the renter’s negligence (e.g., drunk driving, unauthorised driver, traffic violation), the renter shall bear full repair costs and compensation to third parties.

6.3 Damage Responsibility

The renter is fully responsible for all damages not covered by insurance, including tyre punctures, windscreen cracks, and interior stains.

7. Accident, Theft, or Loss / Kemalangan, Kecurian atau Kehilangan

In the event of an accident, theft, or vehicle loss:

1. Notify SMI Auto immediately.
2. Lodge a police report within 24 hours.
3. Provide full cooperation during investigation and claim process.

Failure to comply will void insurance coverage, and the renter will be fully liable for all losses.

8. Late Return / Lewat Pemulangan

If the vehicle is returned later than the agreed time, additional charges will apply according to the daily or monthly rate. Vehicles returned beyond 24 hours late will be charged as an extra rental day.

9. Indemnity & Owner’s Rights / Pampasan & Hak Pemilik

The renter agrees to indemnify and hold harmless SMI Auto, its employees, and agents against all claims, damages, losses, or expenses arising from misuse, accidents, or breach of agreement terms.

10. Termination / Penamatan

SMI Auto reserves the right to terminate the rental immediately if the renter:

• Provides false information.
• Uses the vehicle for illegal purposes.
• Fails to comply with any rental conditions.

Upon termination, the renter must return the vehicle immediately without claim or refund.

11. Governing Law / Undang-Undang

This agreement shall be governed by and construed in accordance with the laws of Malaysia, and any disputes shall be subject to the jurisdiction of Malaysian courts.
